How long does a trademark registration last?

According to sections 48 and 49 of the Trade Marks Ordinance (Cap. 559), the registration of a trademark will last for 10 years from the filing date of the registration application. If you have registered your trademark and wish to extend the period of protection, you can renew your registration. For each renewal, you will be required to pay a renewal fee and the registration will be extended to last for another 10 years. Hence, as opposed to patents and copyrights, a registered trademark can be protected indefinitely as long as you continuously renew its registration.

However, you must bear in mind that if a registered trademark has not been used in Hong Kong for three years continuously, it may be challenged in revocation proceedings. Thus, you must ensure that your registered trademark is not left unused in Hong Kong for at least three years.
